Yesterday, the Dow closed 34.72 points higher, stretching its streak of record-high closes to 10 days.

The streak may come to an end today, though. Dow futures show a lower open before the bell.

Alphabet filed the suit on Thursday at the U.S. District Court in San Francisco.

Waymo, Alphabet's autonomous car division, announced the suit in a blog post last night. The suit accuses Uber and ex-Google engineers of stealing intellectual property and using it to advance Uber's bid in the self-driving car development.

GOOGL stock is currently trading at $851.00 for a 7.4% gain year to date (YTD).

Top Stocks to Watch Today: JCPenney Co. Inc. (NYSE: JCP)

JCPenney stock is down 3% in early morning trading despite slightly better than expected earnings.

The company announced earnings per share (EPS) of $0.64 for the quarter. Analysts were expecting $0.61 EPS.

Despite the better than expected earnings, JCPenney announced that in-store sales fell 0.7% in the fourth quarter.

Along with the EPS, the company also said it will close down between 130 and 140 stores by the end of the year.

JCP stock is currently trading at $6.86 for a loss of 17.5% YTD.

Top Stocks to Watch Today: Hewlett Packard Enterprise Co. (NYSE: HPE)

Hewlett Packard stock is down 8% in early morning trading after posting a disappointing earnings report.

The company reported a net income of $0.16 per share. It reported EPS of $0.45 after it adjusted for restructuring charges. Analysts were expecting EPS of $0.44.

Hewlett Packard also reduced its full-year EPS guidance from $0.72 to $0.82 to a range of $0.60 to $0.70.

HPE stock is currently trading at $24.66 for a gain of 6.6% YTD.

Yesterday, the Dow closed 32.60 points higher to stretch its record close streak to nine in a row. This is the longest streak of record high closings for the Dow in 30 years.

While there are a lot of earnings reports coming out today, the biggest thing moving markets will be any talk focusing on the increased probability of a rate hike. The World Interest Rate Probability moved the odds of a rate hike in March up to 34%. There is now a 61.8% probability that rates will increase in May or sooner, up from 34% yesterday.

EPS was -$6.39 for 2016. The loss was largely due to decreases in revenue. Revenue was down 24% for the quarter compared to the same time period a year ago.

CHK stock is currently trading at $5.92 for a loss of 16% YTD.

Kohl's stock is up 2.5% in early morning trading after posting a better than expected earnings report.

The company posted EPS of $1.44, which is higher than the expected $1.32 EPS. The same quarter last year Kohl's posted EPS of $1.58.

Kohl's reported revenue of $6.205 billion, on target with expectations.

KSS stock is currently trading at $41.78 for a loss of 16% YTD.

Revenue for Mobileye is up 45.6% due to strong demand for autonomous vehicle technology.

MBLY stock is currently trading at $46.12 for a gain of 21% YTD.

Toll Brothers stock is up 5% in early morning trading despite a disappointing earnings report.

The company announced a 3.8% drop in quarterly profits largely due to lower average selling prices for its luxury homes.

Revenue dropped from $928.57 million last quarter to $920.73 million this quarter.

However, there were two bright spots for investors. The first is the company had a 14% increase in new contracts for 2017.

The second is it will start paying a dividend for the first time. The dividend will be $0.08 and will be paid out on April 28.

TOL stock is currently trading at $31.99 for a gain of 3% YTD.

Comparable store sales were up almost 2% from the same quarter a year ago, while revenue as a whole saw an increase of 1%.

Wal-Mart posted adjusted EPS of $1.30, just slightly above the $1.29 EPS analysts predicted.

WMT stock is currently $69.37, which is a gain of 0.4% YTD.
